Terms of Sale.

Article 1 — Purpose
These Terms of Sale (hereinafter the “Terms”) govern all sales made by Emna Shop (hereinafter the “Seller”) through its website at www.emnashop.fr (hereinafter the “Site”).
Any order placed on the Site implies prior, full and unreserved acceptance of these Terms by the customer (hereinafter the “Customer”). These Terms prevail over any other document issued by the Customer.
The Seller reserves the right to amend these Terms at any time. The applicable Terms are those in force on the date the Customer validates the order.

Article 3 — Products and Prices
3.1 — Product description
The Seller endeavours to present the products as accurately as possible. However, photographs and product descriptions on the Site are indicative only. Minor variations in colour, texture or dimensions may exist between the product shown on the Site and the product actually delivered, without constituting a defect.
3.2 — Prices
Product prices are stated in euros, all taxes included, excluding shipping fees. Shipping fees are communicated to the Customer before the final order validation.
The Seller reserves the right to change prices at any time. Products are billed at the prices in force at the time the order is validated.
In the event of a manifest pricing error (an obviously wrong price, a misplaced decimal, etc.), the Seller reserves the right to cancel the order and to offer the Customer to re-place it at the corrected price.
Article 4 — Orders
4.1 — Ordering process
The order process consists of the following steps:
- Selection of products and addition to the cart
- Cart review
- Customer identification (sign-in or account creation)
- Choice of shipping method
- Choice of payment method
- Order summary review and acceptance of these Terms
- Order validation and payment
Validation of the order by the Customer constitutes irrevocable acceptance of the prices, the description of the products ordered, and these Terms.
4.2 — Order confirmation
After payment is validated, a confirmation email summarising the order details is sent to the Customer at the email address provided when ordering.
4.3 — Availability
Product offers are valid within the limits of available stock. If a product becomes unavailable after an order is placed, the Seller will notify the Customer as soon as possible and will offer either a replacement product of equivalent quality and price, or a full refund.
Article 5 — Payment
Payment is made online securely by bank card (Visa, Mastercard) via the Stripe secure payment platform.
The card is debited at the time of order validation. The Seller does not store any of the Customer's bank details. All transactions are handled by Stripe in compliance with PCI-DSS security standards.
If the bank refuses payment, the order is automatically cancelled and the Customer is notified by email.
Article 6 — Delivery
6.1 — Delivery zones and methods
The Seller delivers products throughout mainland France. The following delivery options are available:
- Standard home delivery: estimated 3 to 5 working days
- Pickup-point delivery: estimated 3 to 5 working days
- Express delivery: estimated 1 to 2 working days
Shipping is free for any order of €50 or more (incl. taxes).
6.2 — Delivery times
Stated delivery times are estimates and run from order confirmation. The Seller commits to deliver within a maximum of 30 days from the confirmation date.
6.3 — Receipt and inspection
The Customer is required to inspect the parcel upon receipt. In the event of damage, the Customer must record reservations with the carrier and notify the Seller within 3 days of delivery at contact@emnashop.fr, with photographs of the parcel and the damaged product.
Article 7 — Right of withdrawal
In accordance with articles L.221-18 et seq. of the French Consumer Code, the Customer has 14 calendar days from receipt of the product to exercise their right of withdrawal, without giving any reason or paying any penalty.
To exercise this right, the Customer must notify the Seller of their decision to withdraw by email to contact@emnashop.fr or by postal mail, by means of an unambiguous statement.
The Customer then has 14 days to return the product(s) to the Seller. Return shipping is at the Customer's expense, except in the case of a defective or non-conforming product.
The refund will be issued within 14 days of receipt of the return by the Seller, using the same payment method as the original order.
Article 8 — Return conditions
To be accepted, the return must meet the following conditions:
- The product must be returned in its original state — unworn, unwashed and unaltered
- The product must include all of its original tags
- The product must be returned in its original packaging
- The Customer must include the duly completed return form (provided in the parcel or on request)
Any returned product that is incomplete, damaged, soiled or worn by the Customer will not be accepted or exchanged and will be returned to the Customer at their expense.
Article 9 — Legal warranties
All products sold on the Site benefit from the legal warranty of conformity (articles L.217-4 to L.217-14 of the French Consumer Code) and the warranty against hidden defects (articles 1641 to 1649 of the French Civil Code).
9.1 — Warranty of conformity
In the event of a lack of conformity, the Customer may choose between repair and replacement of the product, subject to the cost conditions provided in article L.217-9 of the Consumer Code. The Customer is exempted from proving the lack of conformity for 24 months from the delivery of the goods.
9.2 — Warranty against hidden defects
The Customer may decide to invoke the warranty against hidden defects under article 1641 of the Civil Code. In that case, the Customer may choose between rescission of the sale or a price reduction in accordance with article 1644 of the Civil Code.
Article 10 — Liability
The Seller is liable for the proper performance of the obligations arising from the sales contract concluded with the Customer. However, the Seller cannot be held liable:
- In the event of force majeure as defined in article 1218 of the Civil Code
- If the product is misused by the Customer
- For damage resulting from temporary inability to access the Site for maintenance or technical reasons
- For the content of third-party sites linked from the Site
The Seller's liability is limited to the amount of the order concerned.
Article 11 — Personal data
Personal data collected when placing an order is necessary to process and deliver orders. It is processed in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act.

In accordance with applicable regulations, the Customer has the right to access, rectify, delete and port their data, as well as the right to object and to restrict processing. These rights can be exercised by email to contact@emnashop.fr.
Article 12 — Intellectual property
All elements of the Site (texts, photographs, images, logos, trademarks, graphics, etc.) are protected by intellectual property laws. Any reproduction, representation, modification or exploitation, in whole or in part, of these elements without the express prior authorisation of the Seller is strictly prohibited and constitutes an infringement punishable under articles L.335-2 et seq. of the French Intellectual Property Code.
Article 13 — Governing law and disputes
These Terms are governed by French law. Any dispute regarding the interpretation or performance of these Terms falls under the jurisdiction of the French courts.
In the event of a dispute, the Customer is informed that they may resort to conventional mediation or any other alternative dispute resolution method. In accordance with article L.612-1 of the Consumer Code, the Customer may, free of charge, refer the matter to the consumer mediator under whose authority the Seller falls.
